"Is it possible for the president to disband the MK? Yes it is quite possible because the number of MK judges would have been unable to meet the quorum," the MK chairman said here on Monday.
Mahfud made the remarks in response to a question raised by a participant at a seminar on the Constitution as the basis for the Continuation of the East Java Regional Development Program.
He said that the current number of MK judges was only nine, including he himself, while based on the rules, an MK session would be considered to have met a quorum if it was attended by at least seven member judges.
"Next December Mr Mufti Fajar would retire, followed by the retirement of two other judges in January next year. So, the remaining number of MK judges would only be six, and thus it is quite possible for the president to dissolve it," he said.
Therefore, he said, he had approached the president to discuss matters with regard to the retirement of the three MK judges in the next several months.
"I was assured by the president that there would be assignments of new MK judges so that the constitutional court would not be dissolved," he added.(*)
